TLC In-Person Code of Conduct
Article 1. Introduction
The Test & Learn Community (TLC) is dedicated to providing a harassment-free experience for participants at all of our events, whether they are held in person or virtually. The TLC Community events are working conferences intended for professional networking and growth in the Product, Marketing, UX, Data, and Experimentation communities. They exist to encourage the open exchange of ideas and expression and require an environment that recognizes the inherent worth and dignity of every person and group. While at TLC Community events, in-person or virtual, or related ancillary or social events, any participants, including speakers, attendees, volunteers, sponsors, exhibitors, and booth staff, should not engage in harassment in any form.
This Code of Conduct may be revised at any time by the Test & Learn Community, and the terms are non-negotiable. Your registration for or attendance at any TLC Community event, whether held in person or virtually, indicates your agreement to abide by this policy and its terms.
Article 2. Definitions
For the purposes of these terms and conditions,
“TLC” refers to the Test & Learn Community, a 501(c)(3) organization, the organizer of Experimentation Island and other in-person TLC Events,
“Event” stands for any in-person event hosted by the TLC, and any activities related to or required for registering for or participation in Event(s),
“You” collectively refers to any legal entity or person, any legal entity’s or person’s agent, any legal entity’s or person's contractor, and any other entity or person on whose behalf a legal entity or person is authorized to act;
“Terms” refers to these terms and conditions for the Events which are entered into by and between TLC and You,
“Agreement” refers to the agreement between You and TLC relating to these Terms and your agreement to comply with them during Events,
“Pass” refers to any activities required to complete registration for the Events, including, but not limited to,
registering via a website or other authorized method,
accepting an invitation to Events,
participating in an Event,
attending Events,
consenting to a third party registering You for an Event,
“Event Participant” refers to an attendee who attends an Event, whether in-person or virtual
“Authorized Third Parties” refers to third parties that TLC contracts with, hires, or otherwise authorizes to act on its behalf for activities and services related to hosting, coordinating, or otherwise delivering any part of the Event.
“Proof of Registration” refers to any method used for authenticating your Registration to gain access to the Event or a related activity or service (e.g., a ticket, a confirmation e-mail, a receipt, or a physical or electronic Event Registration pass),
“Content” refers to any services or materials, written, spoken, produced, recorded, or otherwise made for the Event by TLC, TLC’s related entities, and Authorized Third Parties, including all images, designs, photographs, writings, graphs, data, or otherwise,
“Speaker(s)” refers to any person or other legal entity authorized to present a session, workshop, exhibition, or any other production for the Event,
“Website” refers to the TLC website, the Event Registration website, or any other website or app used by TLC for the Event.
Article 3. Expected Behavior
All event participants, whether attending an in-person or virtual event, are expected to behave in accordance with professional standards, this Code of Conduct, their respective employer’s policies governing appropriate workplace behavior, and applicable laws.
Article 4. Unacceptable Behavior
Harassment will not be tolerated in any form, whether in person or virtually, including, but not limited to, harassment based on gender, gender identity and expression, sexual orientation, disability, physical appearance, body size, race, age, religion or any other status protected by laws in which the conference or program is being held.
Harassment includes the use of abusive, offensive, or degrading language, intimidation, stalking, harassing photography or recording, inappropriate physical contact, sexual imagery, and unwelcome sexual advances or requests for sexual favors. Any report of harassment at one of our events, whether in person or virtual, will be addressed immediately. Participants asked to stop any harassing behavior are expected to comply immediately. Anyone who witnesses or is subjected to unacceptable behavior should notify a conference organizer at once.
Exhibitors should not use sexualized images, activities, or other material in their booths and must refrain from the use of sexualized clothing, uniforms, costumes, or otherwise creating a sexualized environment. Speakers should not use sexual language, images, or any language or images that would constitute harassment as defined above in their talks. Speakers should also use inclusive language, and it is recommended that they take this online course designed to teach the viewer about inclusion, diversity, and unconscious bias.
Individuals who participate (or plan to participate) in TLC Community Conferences, whether it is an in-person event or a virtual event, should conduct themselves at all times in a manner that comports with both the letter and spirit of this policy prohibiting harassment and abusive behavior, whether before, during or after the event. This includes statements made in social media postings, online publications, text messages, and all other forms of electronic communication.
Article 5. Consequences
If a participant engages in harassing behavior, whether in person or virtually, the conference organizers may take any action they deem appropriate depending on the circumstances, ranging from issuance of a warning to the offending individual to expulsion from the conference with no refund. TLC reserves the right to exclude any participant found to be engaging in harassing behavior from participating in any further TLC Community events, Learning Groups, or other activities.
If a participant (or individual wishing to participate in a TLC Community event, in-person and/or virtual), through postings on social media or other online publications or another form of electronic communication, engages in conduct that violates this policy, whether before, during or after a TLC Community event, TLC may take appropriate corrective action, which could include imposing a temporary or permanent ban on an individual’s participation in future TLC Community events.
Article 6. What Should You Do if You Witness or Are Subject to Harassment?
If you are being harassed, notice that someone else is being harassed, or have any other concerns relating to harassment, please contact a member of the conference staff immediately. You are also encouraged to contact:

Article 7. Incident Response
Our staff has taken incident response training and responds to harassment reports quickly and thoroughly. As referenced above, if a participant engages in harassing behavior, whether in-person or virtually, the conference organizers may take any action they deem appropriate, ranging from the issuance of a warning to the offending individual to expulsion from the conference with no refund, depending on the circumstances. TLC reserves the right to exclude any participant found to be engaging in harassing behavior from participating in any further TLC Community events, Learning Groups, or other activities.
Conference staff will also provide support to victims, including, but not limited to:
Providing an Escort
Contacting Hotel/Venue Security or Local Law Enforcement
Briefing Key Event Staff For Response/Victim Assistance
And otherwise assisting those experiencing harassment to ensure that they feel safe for the duration of the conference.
Article 8. Pre-Event Concerns
If you are planning to attend an upcoming event, whether in-person or virtually, and have concerns regarding another individual who may be present, please contact Kelly Wortham at kelly@forwarddigital.org. Precautions will be taken to ensure your comfort and safety, including, but not limited to, providing an escort, prepping onsite event staff, keeping the victim and harasser from attending the same talks/social events, and providing onsite contact cell phone numbers for immediate contact.
